FLX Rewards Program Membership Terms and Conditions (North America)
1 Introduction
1.1 Welcome to the Foot Locker, Inc. (“Foot Locker”) FLX Rewards Program (the “FLX Rewards Program”), a loyalty program through which you receive personalized offers, can earn points and later redeem them for offers, products, services, events, and much more (“Rewards”). Membership in the FLX Rewards Program is free of charge.
1.2 Membership in the FLX Rewards Program is open to (i) residents of the United States and its territories (American Samoa, Guam, Northern Mariana Islands, Puerto Rico, and the United States Virgin Islands), and the Federated States of Micronesia, the Marshall Islands, and Palau (together defined as the “United States”) who are 13 years of age or older and residents of Canada who are 14 years of age or older, (ii) who intend to use the FLX Rewards Program for their own personal, family or household purposes, and not for resale of Foot Locker products or other commercial purposes, and (iii) who have a valid email account and mobile phone number with a +1 dialing code. If a resident has residency in both the United States and Canada, residency will be based on the country of initial enrollment in the FLX Rewards Program. Except where explicitly permitted in writing by Foot Locker, Inc., employees of Foot Locker, Inc. and its subsidiaries cannot participate in the FLX Program.
1.3 By registering for the FLX Rewards Program, you agree to be bound by these FLX Membership Terms and Conditions and the website Terms of Use and Privacy Statements applicable to your residency (Terms of Use and Privacy Statement for the United States or Terms of Use and Privacy Statement for Canada). You may not register if you do not agree to these terms or if you do not meet the eligibility requirements. Foot Locker reserves the right to decline to allow you to participate in the FLX Rewards Program at any time and in its sole discretion if it has cause to believe you do not meet these eligibility requirements or if your participation would violate these Terms and Conditions, any restrictions or limitations that Foot Locker places on purchases, orders, reservations, or offers, or the Terms and Conditions of any other offers or programs offered by Foot Locker. In the case of any conflict between the applicable FAQ and these FLX Rewards Program Membership Terms and Conditions, these FLX Rewards Program Membership Terms and Conditions shall govern.
2 MEMBERSHIP
2.1 You may enroll in the FLX Rewards Program either: (a) online, via www.footlocker.com, www.kidsfootlocker.com, or www.champssports.com for United States members or via www.footlocker.ca or www.champssports.ca for Canadian members, or; (b) at participating United States or Canadian retail stores, currently Foot Locker, Kids Foot Locker and Champs Sports. Upon the completion of your enrollment, you will be assigned an FLX Rewards ID. PLEASE NOTE: The area code assigned to your mobile phone number must be valid and correspond to the country in which you are enrolling, whether such enrollment is online or at a participating retail store. For example, if you have a valid mobile phone number with a United States area code, then you can only enroll online, via www.footlocker.com, www.kidsfootlocker.com, or www.champssports.com, or in a participating United States retail store (i.e., you will not be able to enroll in the FLX Rewards Program online via www.footlocker.ca or www.champssports.ca nor in a participating Canadian retail store). You may be required to validate your mobile phone number as part of the online membership enrollment process.
2.2 To access and manage your FLX Rewards Program benefits, you must log into your FLX Reward Program account (your “Account”). PLEASE NOTE: For online enrollments, you will be prompted to create a password for your Account as part of the enrollment process; however, if you enroll in the FLX Rewards Program in a participating retail store, you will receive an email prompting you to finish setting up your Account online by creating a password. You can use your Account to track your participation in the FLX Rewards Program and redeem your points for Rewards. You are responsible for maintaining the security of your Account, and you are responsible for all activities that occur under your Account. If you believe your Account has been compromised at any time, you are responsible for contacting us immediately by contacting Customer Service at 1-800-991-6883 for United States members, 1-800-479-6674 (Foot Locker Canada) or 1-800-329-2403 (Champs Sports Canada) for Canadian members, or support@flxprogram.com. As an FLX Rewards Program member, you are responsible for ensuring that your information is current and accurate by updating such information as necessary in your account settings.
2.3 There is a limit of: (a) one (1) Account per person; (b) one (1) Account per mobile phone number; and (c) two (2) Accounts per mailing address. Accounts may only be used by individuals – they cannot be used by companies, groups, or organizations – and they cannot be shared or transferred. Accounts are only for personal and non-commercial use. They cannot be used to make bulk purchases or purchases that will be used for resale. Should Foot Locker reasonably suspect a FLX Reward Program member Account of fraud, misrepresentation, abuse or of being in violation of these Terms and Conditions (e.g., using the FLX Rewards Program for reselling products or commercial use, or abusing the FLX Rewards Program’s free returns benefit or Rewards redemption limits, etc.), Foot Locker reserves the right to immediately deactivate or terminate the Account in question, including the forfeiture of all accumulated points, without notice.
2.4 If we need to communicate with you about the FLX Rewards Program, we’ll send a message to the email address associated with your FLX Rewards Program Account. If your email address or other contact information changes after you register, you are responsible for promptly updating your Account.
2.5 We may also send you promotional emails related to the FLX Rewards Program. You may opt-out of promotional emails by following the instructions in the emails. However, please note that you will continue to receive emails related to your membership and purchases.
2.6 You agree to be contacted by us at the phone number you provided in connection with any redemption of Rewards and in the event you win a sweepstakes or contest entered through the FLX Rewards Program.
3 REWARD POINTS AND TIERS
3.1 You can earn points in the FLX Rewards Program (i) by shopping at participating Foot Locker family of companies physical or online retail stores, or (ii) by performing other activities, as communicated from time to time by the FLX Rewards Program, as described in this chart. You may not attempt to earn points in a manner that is not expressly permitted in these Terms and Conditions, such as through the use of a script, bot, or other automated means.
3.2 For physical in-store purchases, your FLX Rewards ID, your associated email address, or mobile phone number must be presented at time of purchase to receive points. For online purchases, you must be logged into your Account via www.footlocker.com, www.kidsfootlocker.com, or www.champssports.com (for United States members) or www.footlocker.ca or www.champssports.ca (for Canadian members) at checkout to receive points.
3.3 Points will typically be added to your Account within approximately three (3) business days from the day you earned them, the day you completed an in-store purchase, or the day your transaction’s order shipped (online or in-store), but it can take up to thirty (30) days. You can log in to your Account at any time to see how many points you have. You are responsible for ensuring that the points balance in your Account is correct. If you believe that you did not receive points or there is some other error in your Account, you must contact us by calling Customer Service at 1-800-991-6883 for United States members, or 1-800-479-6674 (Foot Locker Canada) or 1-800-329-2403 (Champs Sports Canada) for Canadian members, or emailing support@flxprogram.com, all within thirty (30) days of the date of your in-store purchase or the date your order shipped. We will investigate any issues, but Foot Locker’s good faith determination of the number of points available to any member shall be final and binding.
3.4 If you do not earn or redeem any points for 365 days, your points will expire. If you earn points by making a purchase but then cancel the order before shipment or return all the items in that purchase, and all earned points are deducted from your Account pursuant to Section 3.6 below, those earned and deducted points are not considered for the 365-day countdown.
3.5 Except as expressly stated in these Terms and Conditions or otherwise by the FLX Rewards Program, points cannot be earned on purchases made prior to enrollment or on purchases of gift cards.
3.6 The points earned on the purchase of an item will be deducted from your Account if you return the item or cancel the order. If there are not enough points available in your Account, the return or cancellation may result in a negative point balance. Subsequent purchases will work your status back to a positive balance. PLEASE NOTE: If required, any benefits associated with a tier will be adjusted if the return or cancellation of a purchased item affects your eligibility for a tier.
3.7 The points you earn are promotional only, have no cash value, and do not constitute your property of any kind. You cannot sell, barter, or transfer your points or combine them with another member’s points. Once you redeem points for a Reward, the redemption cannot be reversed and is final. Rewards cannot be returned to Foot Locker.
3.8 As described in more detail in this chart, tier status can be reached by meeting the stated spend amount for each tier within an FLX Reward Program Year. Once you reach a certain tier, you will remain in that tier for the remainder of that FLX Rewards Program Year and all of the next FLX Rewards Program Year, unless during the current FLX Reward Program Year you advance to the next tier, if available, based on your spend amount. The FLX Rewards Program Year runs from February 1 at 12:00AM ET to January 31 at 11:59PM ET.
However, the current FLX Rewards Program Year runs from June 18, 2024, at 12:00AM ET to January 31, 2025, at 11:59PM ET, during which time all members will maintain their tier status from the previous FLX Rewards Program Year or advance to the next tier, if available, based on your spend and subject to these Terms and Conditions. As of February 1, 2025, at 12:00AM ET, your Account will be evaluated based on your spend from February 1, 2024, at 12:00AM ET through January 31, 2025, at 11:59PM ET, and you will be assigned a tier status accordingly.
If you earn X2 tier status as of February 1, 2025, you will remain an X2 member until January 31, 2026, at 11:59PM ET (subject to other provisions in these Terms and Conditions). Your status as of February 1, 2026, will depend on your total spend from February 1, 2025, at 12:00AM ET through January 31, 2026, at 11:59PM ET.
PLEASE NOTE: Taxes, gift card purchases, and other miscellaneous fees do not count towards the total spend amount used to calculate tier status. The benefits associated with any tier and how tier status is calculated may change at any time, subject to applicable law. If required, any benefits associated with a tier will be adjusted if the return or cancellation of a purchased item affects your eligibility for a tier.
3.9 Earned points can be redeemed in the FLX Rewards Program’s FLX Dashboard, which can be accessed by (i) logging into your Account via www.footlocker.com, www.kidsfootlocker.com, or www.champssports.com (for United States members) www.footlocker.ca or www.champssports.ca (for Canadian members); or (ii) logging into your Foot Locker United States or Canadian mobile app or your Champs Sports or Kids Foot Locker United States mobile app. Please note that the items, services, and other benefits for which you can redeem points may change at any time and may vary by region. Member benefits are subject to change at any time without notice and may vary by region.
3.10 FLX Program Rewards members will receive an email 30 - 60 days prior to the expiration of their points.
3.11 There is a limit of forty thousand (40,000) points earned from transactions per member per calendar month.
3.12 There is a limit of (1,250) points earned from Engagement Activities per member per calendar month.
3.13 From time to time, Foot Locker, within its sole discretion, may offer promotional opportunities for members to receive bonus points on select purchases. You will only be awarded additional bonus points if you have completed the registration process prior to the start of the promotion. PLEASE NOTE: Additional Terms and Conditions may apply to each such bonus points promotion.
4 REWARDS
4.1 Rewards (e.g., FLX Cash, birthday gift, bonus gift) must be stored in your virtual Rewards wallet (“Wallet”), which can be accessed via your Account’s FLX Dashboard overview. Your Wallet stores all active, unused Rewards (e.g., FLX Cash, birthday gift, bonus gift) that you can apply to future transactions (subject to the additional terms and conditions for any such Rewards). When shopping online, you will have the opportunity to apply your eligible Rewards to your order at checkout. If shopping in a participating United States or Canadian retail store, currently Foot Locker, Kids Foot Locker and Champs Sports, ask a retail store team member to verify your account to apply your eligible Rewards at checkout.
4.2 Rewards may be subject to additional terms and conditions and limitations, including, for example, a limit to the number of a particular Reward a member can acquire or a limit to the time for accessing the Reward. These additional terms and conditions and limitations will be disclosed in connection with the Reward description and are subject to change in Foot Locker’s sole discretion at any time without notice.
4.2.1 Gift Cards - If you do not receive your gift card Reward within three (3) business days from the date you redeem your points for such Reward, please contact Customer Service at 1-800-991-6883 for United States members, 1-800-479-6674 (Foot Locker Canada) or 1-800-329-2403 (Champs Sports Canada) for Canadian members, or support@flxprogram.com. Please note that Customer Service is unable to assist with any questions or issues concerning gift card Rewards thirty (30) days from the date you redeem your points for such Reward.
4.3 Foot Locker is not responsible for any Reward after it has been shipped or emailed or for any Reward that is returned as undeliverable for any reason. Points for those Rewards will not be returned. Foot Locker will not replace any missing or stolen Rewards.
4.4 Members attempting to circumvent these restrictions by means of fraud, creating additional accounts, or other means will be subject to review and termination (including the termination of any accumulated points). Rewards may only be available while supplies last, may be limited in quantity, and/or may only be available for a limited time as determined by Foot Locker, in its sole discretion. The Rewards available to members will be selected solely in the discretion of Foot Locker. Foot Locker reserves the right to substitute a Reward item of comparable or greater value at any time, at its sole discretion. Members are responsible for all applicable federal, state, provincial and local taxes as well as any other costs or expenses associated with a Reward.
4.5 When you redeem your points for Rewards tickets to an event directly from Foot Locker or a vendor partner (“Experience”), it is important to note that your journey to, attendance at, and journey from the Experience will be governed by the terms and conditions for that Experience ticket, including, without limitation, any terms and conditions imposed by any vendor partner issuing the ticket for the Experience, if applicable. For this reason, we ask that you ensure you have read and agree to the terms and conditions of any such Reward Experience.
4.6 Unless otherwise set forth in the additional terms and conditions for a respective Reward, physical products or prizes earned from points cannot be shipped to P.O. boxes, military addresses, locations outside of Canada, locations outside of the contiguous United States, Alaska and Hawaii, nor to United States territories.
4.7 FLX CASH
4.7.1 You can also redeem your points for a Reward called “FLX Cash”. FLX Cash is promotional in nature, is not legal tender, has no cash, exchange or other value except as explicitly provided herein, and no cash back is given. FLX Cash can be used only toward the subtotal of a transaction for items purchased either online or at participating United States or Canadian retail stores, currently Foot Locker, Kids Foot Locker and Champs Sports.
4.7.2 FLX Cash must be redeemed and in your Wallet before use. FLX Cash will automatically be stored in your Wallet upon redemption. You must sign into your Account to apply eligible FLX Cash to online transactions. For in-store transactions, you can ask a retail store team member, upon their verification of your Account, to: (a) apply an eligible FLX Cash Reward to that transaction, either directly through such team member’s access to your Rewards via account verification or by presenting them with your FLX Cash Reward barcode for scanning, or; (b) process a redemption of your then current points for an eligible FLX Cash Rewards, through such team member’s access to your Rewards via account verification. No points are earned for the portion of your transaction that uses FLX Cash. If you redeem points for an FLX Cash Reward, that FLX Cash Reward will expire 70 days from the same date and time of redemption if it is not used sooner. For example, if you redeem points for a $10 FLX Cash Reward on November 1, 2024 at 11:11am EST, that FLX Cash Reward will expire on January 10, 2025 at 11:11 am EST. Unless otherwise specified in the additional terms and conditions of an FLX Cash Reward, all FLX Cash that is gifted to a member (e.g., birthday gift and/or the bonus day gift [the eligibility for which is dependent upon tier status]) will expire 30 days from the same date and time it is awarded to the member, if it is not used sooner. For example, if you are gifted an FLX Cash Reward on November 1, 2024 at 11:11am EST, that FLX Cash Reward will expire on December 1, 2024 at 11:11 am EST. If a transaction to which FLX Cash has been applied is not completed, the FLX Cash will remain in your virtual Rewards Wallet (subject to potential expiry, as described above). If you have multiple FLX Cash Rewards of the same value in your Rewards Wallet, only one will appear at checkout.
4.7.3 Earned points can be redeemed for the following fixed denominations of FLX Cash:
Redeem 15,000 points for $5 FLX Cash
Redeem 30,000 points for $10 FLX Cash
Redeem 60,000 points for $20 FLX Cash
4.7.4 You are only permitted to redeem a maximum of 120,000 points for FLX Cash per calendar month (starting at 12:00 AM ET on the first day of each such calendar month and ending at 11:59 PM ET on the last day of each such calendar month).
4.7.5 PLEASE NOTE:
4.7.5.1 Online Transactions. For online transactions, the FLX Cash Reward is applied to the subtotal before any other eligible discount, taxes or fees; additionally, the FLX Cash denomination must be less than the subtotal before any other eligible promotional offers, taxes or fees are applied. Only up to one (1) other eligible promotional offer can be applied with FLX Cash in a single transaction. Additional terms and conditions or exclusions may apply.
4.7.5.2 In-Store Transactions. For in-store transactions, the FLX Cash Reward is applied to the subtotal after any other eligible discount, but before taxes or fees; additionally, the FLX Cash denomination must be less than the subtotal after any other eligible promotional offers, and before taxes or fees are applied. Only up to one (1) other eligible promotional offer can be applied with FLX Cash in a single transaction. Additional terms and conditions or exclusions may apply.
4.7.6 You can check how much FLX Cash you are eligible to redeem based on your points total by: (i) logging into your Account via www.footlocker.com, www.kidsfootlocker.com, or www.champssports.com (for United States members) or www.footlocker.ca or www.champssports.ca (for Canadian members); (ii) logging into your Foot Locker United States or Canadian mobile app or your Champs Sports or Kids Foot Locker United States mobile app; or (iii) asking an associate in any United States or Canadian Foot Locker, Kids Foot Locker or Champs Sports retail store.
4.7.7 If you are entitled to a refund of FLX Cash, that amount will be refunded in the form of points back to your Account. PLEASE NOTE: FLX Cash will be refunded as the number of points, corresponding to the refunded FLX Cash amount, to the original Account from which the FLX Cash Reward was applied.
4.7.7.1 If you would like to initiate a full or partial return for a transaction in which FLX Cash was applied, the original Account member whose FLX Cash Reward was applied will be refunded with a credit to their Account with the number of points corresponding to the pro-rated refund of FLX Cash that was applied to the returned item(s) in that transaction. In-store returns, for transactions in which FLX Cash was applied, cannot be processed as multiple returns and need to be processed separately per transaction.
4.7.7.2 FLX Rewards members in good standing qualify for free online returns, subject to Foot Locker’s returns policies (Foot Locker United States, Champs Sports United States, Foot Locker Canada, Champs Sports Canada). Please note you must be logged into your FLX Rewards account when the order is placed to be eligible for free returns. Foot Locker reserves the right to monitor return activity by FLX Rewards Program members for abuse (e.g., excessive number of returns or suspected resale activity, etc.) and take any action we deem necessary in our sole discretion, including limiting free returns or exchanges in all instances and immediately deactivating or terminating accounts found to be abusing the FLX Rewards Program (including the forfeiture of all accumulated points)
4.7.8 PLEASE NOTE: FLX Cash cannot be: (i) used with a coupon or offer received as a result of your participation in the Customer Pulse Survey; (ii) used with more than one (1) other coupon code (e.g., student discount); (iii) applied by members towards orders placed by a retail store team member (e.g., Foot Locker’s Customer Service team), online reservations/ship to me entries for sneaker releases, taxes, shipping and/or handling or any other applicable fees; (iv) sold, bartered, transferred or exchanged for cash; (v) combined with other FLX Cash Rewards within the same transaction; or (vi) used to purchase gift cards (electronic or physical) to any of Foot Locker, Kids Foot Locker and Champs Sports. Gift cards cannot be included in a transaction in which FLX Cash is applied and would have to be purchased separately. If any amount of an FLX Cash Reward remains unused after being applied to a transaction (e.g., if the FLX Cash Reward being applied is greater than the transaction subtotal), the balance of such FLX Cash Reward will be forfeited.
5 CHANGES, TERMINATION, OR REMOVAL FROM PROGRAM
5.1 You may deactivate your Account at any time by calling Customer Service at 800-991-6883 for United States members or 1-800-479-6674 (Foot Locker Canada) or 1-800-329-2403 (Champs Sports Canada) for Canadian members. Deactivating your FLX Rewards Program membership will not affect any other account you may have with the Foot Locker family of companies or email preferences to receive marketing emails from any of the Foot Locker family brands.
5.2 If you deactivate your Account, or if it is deactivated or terminated for any reason, any points which remain in such Account will be forfeited.
5.3 Subject to applicable law, Foot Locker may, at its sole discretion, terminate, deactivate, alter, limit, suspend, or modify the FLX Rewards Program, and/or these Terms and Conditions, rules, regulations, or benefits at any time, without notice or cause, even though such modifications may affect the ability to earn or redeem points. It is your responsibility to check or review these Terms and Conditions from time to time to keep informed of any changes. However, Foot Locker may, at its discretion, notify members of any material change sixty (60) days in advance of the effective date of any change (or as otherwise required by applicable law). Change notices may be communicated by postings in the FLX Rewards Program or by emails to members.
5.4 Interpretation of these Terms and Conditions shall be at Foot Locker’s sole discretion. Foot Locker’s failure to exercise or enforce any right or provision of these rules shall not constitute a waiver of such right or provision.
5.5 Foot Locker reserves the right to review account activity for patterns that fall outside the intended use of the Program or what is allowed under these Terms and Conditions. Foot Locker may, in its sole discretion, determine any violations.
5.5.1 In case of suspected fraud, misrepresentation, abuse, or violation of these Terms and Conditions, Foot Locker reserves the right to take appropriate administrative and/or legal action, including the termination of your FLX Rewards Program membership. In such cases, you may lose any points you had accumulated.
5.5.2 If for two (2) consecutive years you have neither made any purchases, redeemed any points, logged
into your Account nor completed any non-purchase points-earning activity, Foot Locker reserves the right to deactivate your Account for inactivity. Once your Account is deactivated, you will no longer have access to the FLX Rewards Program’s member benefits. Please contact Customer Service via the contact information listed in Section 8 below with any questions.
5.5.3 If for 365 consecutive days your active, available points balance is zero or less, Foot Locker reserves the right to deactivate your Account for inactivity. Once your Account is deactivated, you will no longer have access to the FLX Rewards Program’s member benefits. Please contact Customer Service via the contact information listed in Section 8 below with any questions.
6 LIMITATION OF LIABILITY
Foot Locker will not be liable for any system failure or malfunction of the FLX Rewards Program or any consequences thereof. Foot Locker will not be liable for any loss or damages arising from suspension, variation, termination, or in any other way relating to the FLX Rewards Program, except for any liability which cannot be excluded by law. By participating, you agree that Foot Locker, its parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents shall not be liable to you or any third party for: (a) any damages arising out of your participation in the FLX Rewards Program except to the extent caused by Foot Locker’s intentional misconduct, recklessness, or gross negligence, and (b) any indirect, special, punitive, exemplary, aggravated, incidental or consequential losses or damages, including lost profits, regardless of whether such damages were foreseeable and regardless of whether we were advised of the possibility of such losses or damages. These limitations shall apply to all claims and theories of liability to the fullest extent allowed by applicable law.
7 APPLICABLE LAW
For United States residents, these Terms and Conditions shall be governed by and construed in accordance with the laws of the state of New York in the United States. Any dispute, claim, or controversy arising or relating to these Terms and Conditions and the FLX Rewards Program shall be resolved by the courts in New York State.
For Canadian residents, these Terms and Conditions shall be governed by and construed in accordance with the laws in effect in the Canadian province or territory in which you reside, which may include the province of Quebec. The parties hereby consent to the exclusive jurisdiction of the courts of the Canadian province or territory whose law governs these Terms and Conditions.
